What is medical malpractice insurance?
It’s professional liability coverage for healthcare providers. It helps pay legal defense and settlements/judgments if a patient alleges negligence, errors, or omissions tied to your professional services.
Who needs it?
Physicians, surgeons, dentists, nurse practitioners, PAs, RNs/LPNs, therapists, counselors, med spas, clinics, locums, and telehealth providers. If you diagnose, treat, prescribe, advise, or perform procedures—you’re in scope.
Claims-made vs. Occurrence—what’s the difference?
Claims-made responds when the claim is made (reported) and your policy is active—usually needs a “tail” if you cancel or move carriers.
Occurrence responds based on when the incident occurred, even if the claim is filed years later—no tail needed.
What is tail coverage (Extended Reporting Period)?
Tail lets you report claims after a claims-made policy ends for incidents that happened while it was active. You’ll want it when switching carriers, retiring, or leaving an employer. It’s a one-time purchase and can be pricey—plan ahead.
What limits should I choose?
Common options are $1M per claim / $3M aggregate or $2M/$4M. Hospital privileges, contracts, and state norms often dictate minimums. Higher-risk specialties or procedures may warrant higher limits.
Do defense costs reduce my limits?
Depends. Some policies include defense inside the limits (eroding your limit as legal bills accrue). Others place defense outside the limits. Ask for “defense outside limits” when possible.
What is a consent-to-settle clause (a.k.a. “hammer”)?
True consent clauses require your approval to settle. A “hammer clause” may penalize you financially if you refuse a recommended settlement. Know which version you have—this affects leverage and outcomes.
Will my policy cover telemedicine or aesthetics (e.g., injectables, lasers)?
Often yes, but it must be listed in your application and approved. Coverage can depend on licensure, scope of practice, setting (clinic vs. med spa), and the states where you treat patients.
How are premiums calculated?
Specialty risk class, procedures performed, location, limits/deductible, practice hours (full-time vs part-time), claims history, risk-management training, and whether you’re individual or entity all play a role.
What is a retroactive date / prior-acts coverage?
Your retro date is the earliest date your policy covers incidents from. When switching carriers, ask for prior-acts so you keep that original retro date. Losing it leaves a gap.
Does malpractice cover board complaints, depositions, or HIPAA/privacy events?
Many policies offer sub-limits for licensing board defense, depositions, and HIPAA/privacy investigations—but not all. Check endorsements and sub-limits; add cyber/privacy coverage if needed.
Are claim payments reported to the NPDB?
Yes—insurer payments for medical malpractice are generally reportable to the National Practitioner Data Bank. Expect credentialers and hospitals to see that record.
Can I get coverage for my practice entity and staff?
Yes. Policies can include the professional entity and employed/contracted professionals. Make sure roles (RN, MA, aesthetician, etc.) and locations are accurately scheduled.
How fast can I get a certificate of insurance?
For clean risks, same-day or next-day after binding is common. Complex specialties or prior claims can take longer due to underwriting.
