What does Professional Liability (E&O) actually cover?
It helps pay for claims that your professional services had an error, omission, or were allegedly negligent—think bad advice, missed deadlines, or mistakes in deliverables. It typically covers legal defense, settlements, and judgments (up to your limits), even if a claim is groundless.
Who needs E&O insurance?
If you sell advice or specialized services, you do. Common examples:
  • Consultants, agencies, designers, and developers
  • Real estate, insurance, and financial professionals
  • Healthcare and allied health (often via specialized forms)
  • Architects, engineers, accountants, attorneys (usually bespoke policies)
Is E&O the same as General Liability?
No. General Liability covers bodily injury, property damage, and certain advertising injury. E&O covers financial loss from your professional services (bad advice, errors, omissions). Most contracts expect both.
Claims-made vs. occurrence—what’s the difference?
E&O is usually claims-made: the policy in force when the claim is made responds (not when the work was done). You’ll see terms like retroactive dates and tail coverage because timing matters.
What’s a retroactive date and why should I care?
The retro date is the earliest date your prior work is covered. Keep it as far back as possible and don’t let it reset when you switch carriers—otherwise older work may be uninsured.
Do I need tail coverage (extended reporting period)?
Yes if you’re canceling, selling, or pausing operations. Tail coverage lets you report claims after the policy ends for work done while it was active. Without it, late-arriving claims can be denied.
Are defense costs inside or outside the limits?
Depends on the policy. Inside the limits means legal fees erode your limit. Outside preserves your limit for settlements. Ask for outside if available, or set higher limits when defense is inside.
What’s typically excluded?
Intentional wrongdoing, fraud, bodily injury/property damage (that’s GL), employment-related claims (EPLI), and many cyber/Privacy events (Cyber). Contractual guarantees and fee disputes are often limited or excluded.
How much does E&O cost?
Pricing is based on your profession, revenue, claims history, limit/deductible, and client mix. Entry-level policies for low-risk consultancies may start in the low four figures annually; higher-risk fields run more. A quick quote is the only honest way to know.
What limits should I carry?
Start with your largest contract requirement. Common small-business limits are $1M per claim / $1M–$2M aggregate. If projects are high-stakes or you have defense-inside-limits, consider going higher or adding excess.
Are subcontractors and 1099s covered?
Often only for your vicarious liability not their independent work. Require subs to carry their own E&O and name your company as an additional insured when possible (if the form allows).
How do I prove coverage to a client fast?
Ask us for a Certificate of Insurance (COI) with the exact wording your contract requires. We can usually turn COIs quickly, but unusual endorsements may take carrier approval.
What should I do if I suspect a claim?
Report it early, even if it’s just a “circumstance.” Late notice can jeopardize coverage on claims-made policies. Save communications, pause fixes that could alter evidence, and loop us in so we can quarterback the response.
